Meeting Minutes of February 2, 2004

   

 Meeting called to order at 9:00 a.m. by Secretary Joni Huff.  Those present: Chair Christy Stutzke Vice Chair Eric Negaard, Carol Martin, Geneal Thompson, and Joni Huff.  Bureau Staff present:  Rayola Jacobson, Budd Hetrick, and Kim Aksamit. Legal Counsel: Carl Ericson, Deputy Attorney General Kenneth Stringfield. 

Motion by Ms. Martin to accept minutes from October 6, 2003 and December 29, 2003 seconded by Mr. Negaard; motion carried. 

Motion by Ms. Martin by acclamation that Board Chair for 2004, Board Vice Chair for 2004 and Board Secretary for 2004 remain the same for the year 2004; seconded by Ms. Huff; Motion carried. 

Ms. Jacobsen Reported on the requested law and rule changes that have been submitted to the legislation. 

Moved by Mr. Negaard to accept the new language on law 54-828, 54-831 and 54-832 with the suggested changes; seconded by Ms. Martin; motion carried. 

Wendell Peterson the NIC President was introduced. 

The Board reviewed and signed NIC contract. 

Board reported on SMT test cores for examiners where above national average. 

Moved by Ms. Martin to except the curriculum for The Burton Academy of Beauty Culture except for esthetics; seconded by Ms. Huff; discussion was held on providing to the Bureau list of instructors, addressing the disability classroom issue, the medical esthetics, and the nondiscrimination policy with the addition of the word disability; motion carried. 

Break for lunch 

Mr. Hetrick gave the financial report. 

Motion made by Ms. Martin to except the financial report; seconded by Ms. Thompson; motion carried. 

Mr. Hetrick gave the investigative report. The Board reviewed Bureau recommendations regarding pending cases.

COS-L1B-2-04-02 Moved by Ms. Martin, seconded by Mr. Negaard and carried to accept the Bureau’s recommendation and close the case. 

COS-P3-02B-02-83 Moved by Mr. Negaard; seconded by Ms. Huff, to take this matter to hearing. Discussion was held and the motion failed. 

P3-02B-02-83 Moved by Ms. Thompson, seconded by Ms. Martin, and carried that, upon review of the Attorney General report dated January 27, 2004, a consent agreement be drafted to include that both the respondents personal and shop licenses be suspended for 365 days with 185 days stayed, and payment of a minimum fine of $5000.00 with $2000.00 stayed, plus recovery of the cost of investigative and attorney fees, and a two year probation. Respondents husband to receive a 365 day suspension with 185 days stayed, and payment of a minimum fine of $5000.00 with $2000.00 stayed on his personal license, plus recovery of investigative and attorney fees, and a two year probation. 

Moved by Ms. Huff, seconded by Ms. Thompson, and carried to go into executive session to discuss pending litigation exempt from public disclosure. 

Moved by Ms. Thompson, seconded by Ms. Huff, and carried to come out of executive session. 

COS-2004-7 Moved by Ms. Thompson to accept the voluntary relinquishment of the license and enter an order revoking the same; seconded by Ms. Huff; motion carried. Ms. Stutzke and Mr. Negaard recused themselves from the discussion and vote. 

COS-2003-3 Moved by Ms. Thompson to deny the request for reconsideration; seconded by Mr. Negaard, motion carried with one opposed. 

COS-2004-4 Moved by Mr. Negaard to accept proposed consent order, seconded by Ms. Thompson; motion carried. 

COS-2004-6 Moved by Ms. Thompson to accept the final order, seconded by Ms. Martin; motion carried. Mr. Negaard recused himself from the discussion and vote. 

Ms. Stutzke called Ms. Thompson to the chair, in order to take part in the discussion. 

COS-2004-1 Motion made by Ms. Martin to deny request, seconded by Ms. Stutzke; motion carried. 

Ms. Stutzke resumed the chair. 

The School Owners Association discussed their proposal for legislation to raise the instructor to student ratio to 1 instructor for 20 students. Discussion was held and no action was taken. 

The School Owners Association discussed sending final records to the Bureau electronically. Discussion was held and no action was taken. 

Fees were discussed. The Board noted that an Idaho licensee seeking an instructor license must send in the fee of $80.00 when making application.

The Board reviewed applications received by the Bureau.
