November 17, 2003

Meeting called to order at 12:30 pm. by Chair Christine Stutzke. Those present: Vice President Eric Negaard Carol Martin, Geneal Thompson, and Joni Huff. Bureau staff present: Rayola Jacobson, Budd Hetrick, and Kim Aksamit. Legal counsel: Carl Ericson.
Motion
made by Mr. Negaard to go into executive session to discuss disciplinary
matters; seconded by Ms. Thompson; motion carried.
Motion
made by Mr. Negaard to come out of executive session; seconded by Ms. Huff;
motion carried.
Motion made by Ms.
Martin; seconded by Ms. Thompson and carried that the Board accept the Hearing
Officers Findings of Fact, Conclusion Of Law and Recommended Order in the matter
of COS-2004-2.
Motion made by Ms.
Thompson to go into executive session to discuss disciplinary matters; seconded
by Ms.Martin; motion carried.
Motion made by Ms. Martin
to come out of executive session; seconded by Mr. Negaard; motion carried.
Motion
made by Mr. Negaard; seconded by Ms. Huff and carried that the Board accept the
Stipulation and Consent Order as written for COS-2004-10.
Motion
made by Ms. Thompson to go into executive session to discuss disciplinary
matters; seconded by Ms. Huff; motion carried.
Motion
made by Mr. Negaard to come out of executive session; seconded by Ms. Martin;
motion carried.
Mr.
Negaard recused himself from discussion and participation on case COS2004-3.
Motion by Ms. Huff;
seconded by Ms. Thompson and carried that the Board accept the Consent Order as
written COS-2004-3.

Thompson to go into executive session to discuss disciplinary matters; seconded
by Ms. Martin; motion carried.
Motion made by Ms. Huff
to come out of executive session; seconded by Ms. Martin; motion carried.
Motion made by Ms. Huff;
seconded by Mr. Negaard and carried that the Board accept the Consent Order as
written for case #COS-2004-9.
Motion made by Ms. Martin
to go into executive session to discuss disciplinary matters; seconded by Ms.
Huff; motion carried.
Motion made by
Ms.Thompson to come out of executive session; seconded by Mr. Negaard; motion
carried.
Motion made by Ms.
Martin; seconded by Ms. Huff and carried that the Bureau of Occupational
Licenses respond by letter to Case # COS-2003-1 for acknowledgment of her
request for payment arrangements advising her that a monthly payment is
acceptable although respondents personal license will remain cancelled until she
has met the terms of the Final Order in the matter of her Idaho cosmetology
license.
Motion made by Ms. Martin
to put in board policy that applicants who have taken and passed Idaho
jurisprudence examination will not be required to take it with in a five year
period if pursuing another Idaho license as long as Legal counsel looks at it
and deems it lawful. seconded by Mr. Negaard; motion carried.
The Board asked that
legal counsel review the necessity of proposing a law or rule change to address
the jurisprudence exam issue.
Motion made by Ms.
Thompson to pay NIC $3,500.00 for the rater training session January 31st
and February 1st 2004, with the number attending not to exceed 23;
seconded by Ms. Huff; motion carried.
Board is requesting that
new Examiners get paid Per dim and travel expenses for the NIC training.
Motion by Mr. Negaard to
go into executive session to discuss applicant files; seconded by Ms. Huff;
motion carried.
Motion made by Mr.
Negarrd to come out of executive session; seconded by Ms. Martin; motion
carried.
Motion made by Mr.
Negaard regarding the ADA accommodations matter, that the Board stands firm on
their decision and applicant needs to retrain for 80 hours and instructs legal
counsel to send a letter in this matter; seconded by Ms. Martin; motion carried.
Motion made by Mr.
Negaard that Ms. Jacobsen proceed with the drafting of a statute change
pertaining to 54-828 which will strike the requirement for appointment of
examination assistants by the Governor; seconded by Ms Thompson; motion carried.
Motion made by Mr.
Negaard to go into executive session to discuss matters pertaining to the
examination; seconded by Ms. Huff; motion carried.
Motion made by Ms.
Thompson to come out of executive session; seconded by Ms.Huff; motion carried.
