Meeting Minutes of June 2, 2003

 Meeting called to order at 8:30 a.m. by Vice President Eric Negaard.  Those present: Carol Martin, Geneal Thompson, and Joni Huff.  Bureau staff present:  Rayola Jacobson, Budd Hetrick, John Kersey, Carl Ericson, and Kim Aksamit.  Absent Christine Stutzke - Chair.  

Motion by Ms. Martin to accept minutes from February 3, 2003; seconded by Ms. Thompson; motion carried.

Ms. Jacobsen Reported on the new law that will become effective July 1, 2003 that will change the expiration date on licenses to birth dates.    

Mr. Hetrick gave the financial report.

Mr. Kersey presented to the board the stipulated consent agreement completed for case #COS-B1B-02B-01-011, regarding the disciplinary action of Pro Nails. 

Moved by Ms. Martin to accept the recommendation for case #COS-B1B-02B-01-011 with changes made from 10 days suspension to 30 day suspension; seconded by Ms. Huff; motion carried. 

Dora Warner brought forth to the board to disregard the required number of exercises completed on the record of instruction.  As it stands now the Bureau doesn’t require amount of services just the amount of hours completed.

Budd Hetrick assured the Board that no disciplinary action has been taken against a school for miscalculation of services since there is no rule for number of services performed in a school of Cosmetology.

Nancy King spoke on sanitation and discussion was held. Discussion included the effectiveness of bleach and alcohol when used as a sanitizing agent for instruments.  It was recommended that the Board consider revising the laws and rules to provide for sanitizing agents not included under EPA registration.  It was also recommended that the Board revise the requirements so they did not reference EPA registration, as such registration may not be applicable to the practice of cosmetology.  The Board will review the information presented and have further discussion at a later meeting.

The Associated Cosmetology Schools of Idaho requested clarification from the Board on who needs to have a demonstration permit; Discussion was held and explained.

Erik Negaard informed the people in the gallery that the Board has asked the Bureau to help them in rewriting the law and rule, which will change the requirements for an instructors license.  In allowing an instructor after completing 1000 hrs of training they can immediately go ahead and register and take the examination without the one year of  work experience.

Open discussion was held on apprenticeships per Board Member Geneal Thompson.

Moved by Ms. Thompson to go into executive session to review matters of potential litigation; seconded by Ms. Martin; motion carried.

Moved by Ms. Martin to come out of executive session seconded by Ms. Huff; motion carried.

Moved by Ms. Thompson to except recommendation for case #COS-P3-01-02-85 with changes made to $100.00 fine and 8 hours of continuing education in basic color application and Theory; seconded by Ms. Martin; motion carried. 

Also presented was the consent agreement completed for case #COS-L6A-01-03-38 Moved by Ms. Thompson to accept the recommendation by the Deputy Attorney General; seconded by Ms. Huff; motion carried. 

Moved by Ms. Huff to accept case #COS-B5A-02B-03-23 with the exception of no apprenticeship program for 5 years; seconded by Ms. Thompson; motion carried.

Moved by Ms. Martin to accept case #COS-P1B-01-03-19 and COS-B1B-01-03-34 as recommended by the Attorney Generals office; seconded by Ms. Huff; motion carried.

Moved by Ms. Huff to accept recommendation from Attorney Generals Office for case #COS-P1-02B-03-31; seconded by Ms. Thompson; motion carried.

Moved by Ms. Thompson to accept recommendation for case #COS-B1B-04-03-35 with regards to changes of a 60 day suspension with 30 days stayed and $1000.00 fine and 2 years probation; seconded by Ms. Martin; motion carried.

Mr. Hetrick gave the investigative report. 

Motion made to recess for lunch by Ms. Thompson; seconded by Ms. Martin; motion carried.

Motion made to reconvene by Ms. Huff; seconded by Ms. Thompson; motion carried.

The Board directed the Bureau to research the issue of requiring liability insurance for establishments and provide the Board with a recommendation.

Discussion was held on the 48th Annual NIC Conference. A motion was made by Ms. Martin to provide reimbursement to Board attendees for registration, hotel, per diem, and shuttle service to and from the airport; seconded by Ms. Thompson; motion carried. The Board noted that any rental car costs would not be reimbursed.

Break for 10 minutes

Motion made by Ms. Thompson that all current licensees wishing to upgrade their license must take the State Law Exam until further review in October; seconded by Ms. Huff; motion carried. 

Moved by Ms. Martin to go into executive session to discuss the examination; seconded by Ms. Huff; motion carried.

Moved by Ms Thompson to come out of executive session; seconded by Ms. Martin; motion carried.
