Minutes of December 29, 2006

 

 

The Idaho State Cosmetology Board meeting was called to order at 9:04 a.m., Friday, December 29, 2006

at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

 

Roll Call:          Eric Negaard, Chair

                         Joan Huff, Board Member

                         Mary Lambert, Board Member

                         Bonnie Sermon, Board Member

                         Mildred Herbold, Board Member

                            Roger Hales, Administrative Attorney

                            Marcie McGinty, Investigations Coordinator

 

FORMAL DISCIPLINARY ACTION

 

Roger Hales discussed the Findings of Fact, Conclusions of Law, and Recommended Orders issued by

the Hearing Officer for Case Numbers COS-2006-10, COS-2006-11, COS-2006-25 & 26 and

COS-2006-30 & 31.  After review and discussion of each case the Board made the following motions

for Final Orders:

 

COS-2006-10:  Moved by Ms. Herbold to adopt the Hearing Officers Findings of Fact and Conclusions

of Law in the matter of Karen Madrid, License No. NT-1625.  That Respondents license shall be

suspended for a period of two (2) years and she shall be required to pay the costs and attorney fees

incurred in the investigation and prosecution and pay a fine in the amount of One Thousand Dollars

($1,000).  Seconded by Ms. Lambert, motion carried.

 

COS-2006-11:  Moved by Ms. Huff to adopt the Hearing Officers Findings of Fact and Conclusions of

Law in the matter of Jordan Moore, License No. RC-224901.  That Respondents license is revoked and

he shall be required to pay the costs and attorney fees incurred in the investigation and prosecution.  Seconded by Ms. Lambert, motion carried.

 

COS-2006-25 & 26:  Moved by Ms. Lambert to adopt the Hearing Officers Findings of Facts and

Conclusions of Law in the matter of the license of Star Nail & Pedi and Huy Nguyen, Owner.  That          Respondents licenses be revoked and he shall be required to pay the costs and attorney fees

incurred in the investigation and prosecution.  Seconded by Ms. Huff, motion carried.

 

COS-2006-30 & 31:  Moved by Ms. Lambert to adopt the Hearing Officers Findings of Fact, and

Conclusions of Law in the matter of The Hair Depot, License No. CS-227801 and Christy Bahem,

License No. RC-16152.  That Respondents licenses be suspended for a period of sixty (60) days

and she shall be required to pay the costs and attorney fees and a Five Hundred Dollar ($500.00)

for each license.  Upon the conclusions of the suspension Respondent must appear before the

Board prior to any reinstatement of licensure.  Seconded by Ms. Herbold, motion carried.

 

OTHER BOARD BUSINESS

 

Mr. Negaard brought to the Board’s attention recommended nominees to be exam proctors for the

DL Roope examinations.  Based on the recommendations and full discussion and consideration

from the Board the following motion was made:

 

Moved by Ms. Herbold to approve Darol R. Ady, Alena Martin-Mangum and Georgia L. Small to be exam          proctors for DL Roope.  With one condition that Ms. Small not be employed or teaching as an instructor

at any of the Idaho cosmetology schools.  Seconded by Ms. Huff, motion carried.

 

There being no further Board business Ms. Lambert moved to adjourn the meeting.  Seconded by

Ms. Huff, motion carried.  The time being 9:49 a.m.
