MEMORANDUM

                SUBJECT:         Complaint Investigation Report   

 

FY2007: To date, one hundred sixty-nine (169) complaints have been received. Of those, two (2) have been closed following Board determination; one hundred sixty-seven (165) are under investigation; and two (2) await Board determination.

FY2006: Fifty-six (56) complaints were received.  Of those, seventeen (17) have been closed following Board determination; twelve (12) have been referred for disciplinary review; twenty-seven (27) remain under investigation.

Complaint issues are as follows:

Unregistered practice - 29
Competency - 6
Failure to complete construction - 11
Contract issue - 15
Failure to deliver - 11
Fraud - 4
Liability Insurance - 149

For Board Determination:

CON-P4-02-2007-12            C alleged that R, upon signing a written agreement w/ deposits paid up front, stated project should take approximately 2 months. R failed to complete and C hired someone else to complete the job. INV revealed that the contract contains no start or completion dates. Contract also notes that C is responsible for all costs if contract is terminated. C's allegations of poor workmanship were unsubstantiated as R was not allowed to complete work. INV did not reveal evidence to support the allegations or violation of law or rule. IBOL recommends the Board authorize closure.

CON-P1-02-2007-18            C alleged that R is an out of state contractor doing work in Idaho without the benefit of registration. INV revealed that R is an Idaho Public Works contractor and is exempt from registration. It was confirmed that R bids & works on PW jobs in Idaho. INV did not reveal evidence of a violation of law or rule. IBOL recommends the Board authorize closure.
