Meeting Minutes of June 01, 2004
CONFERENCE CALL MEETING

Meeting was called to
order at 12:30 p.m. by Chair, Dr. Dennis Harper.
The minutes from the June
01, 2004 Board meeting were reviewed. Motion
was made by Dr. Moldenhauer to change the word “even” to “event”, and
than approve the minutes. Seconded
by Dr. Mayo, carried.
The Board reviewed a
letter sent by a licensee. The
licensee had performed a pelvic examination and ordered a pap smear.
Examination showed complications, and the patient was referred to a
Medical Doctor. The licensee
received a letter from the Board of Medicine stating the doctor was practicing
medicine in violation of the medical act. The
Board reviewed Idaho Statute 54-703
(1). The Board determined that the
described procedure fell under Gynecology and not Obstetrics.
Pelvic examinations are taught in Chiropractic Colleges, and Part III of
the National Board Examination deals with pelvic examinations.
Motion was made by Dr.
Mayo to have the administrative attorney, Roger Hales, draft a letter to the
Board of Medicine explaining the Board’s position.
That Gynecological examinations are within a Chiropractor’s Scope of
Practice; that Chiropractor's are trained in Chiropractic College to perform
such procedures; that Chiropractor's are examined for such procedures by the
National Board; and that the procedure the doctor performed was Gynecology, and
not Obstetrics. The Board will
review the letter drafted by Roger before sending.
Seconded by Dr. Moldenhauer, carried.
Dr. Sterling noted that
he would get with the Bureau secretary to set up a date and time for peer review
training.
Motion was made by Dr.
Moldenhauer to have the Bureau draft an insert to be added in licensing notices
with information regarding Peer Review. Dr.
Sterling and Dr. Mayo will review this insert.
Seconded by Dr. Sterling, carried.
Motion was made by Dr.
Sterling to go into executive session to consider application records that are
exempt from disclosure as provided in chapter 3, title 9, Idaho Code.
Seconded by Dr. Mayo, carried.
Motion was made by Dr.
Mayo to come out of executive session. Seconded
by Dr. Sterling, carried.
Motion was made by Dr.
Mayo to request that applicant, CHI-P3C-01-00-015, be invited to the next
scheduled Board meeting to meet with the Board.
The Board will re-evaluate the applicant’s situation. Administrative
attorney, Roger Hales, will check to see if the applicant has met everything
required in the stipulation. Seconded
by Dr. Moldenhauer, carried.
File CHI-P4B-03-00-004
was brought to the Board for recommendations for a stipulation. Complaint
alleged excessive billing.
Motion was made by Dr.
Mayo to negotiate a stipulation of 90 day license suspension with 14 days
imposed; one year probation; $1000.00 fine, respondent must pay all costs acquired,
must complete a continuing education seminar on Risk Management within the time
of probation; the Board will do a random audit of various patients’ records
for the last six months; the Board has the right to do additional audits
throughout the 90-day probation period. Seconded
by Dr. Sterling, carried.
If the respondent signs
the stipulation, the stipulation will be brought back to the Board. If
the respondent does not sign the stipulation, than the case will go to a
hearing.
Continuing Education
request for approval was reviewed.
Motion was made by Dr.
Moldenhauer to send a letter to respondent stating the seminar does not fit
within the Board’s parameters. The
Board appreciates the quality of the seminar, but because the seminar is not
being sponsored by a CCE approved school, the Board denies the request.
Encourage respondent to submit continuing education requests for approval
prior to attending the seminar. Seconded
by Dr. Sterling, carried.
Board reviewed applicant
DCA-GJH-1-10-2003 file.
Motion was made by Dr.
Moldenhauer to invite applicant to the next scheduled Board meeting to meet with
the Board. The Board will
re-evaluate the applicant’s situation. Seconded
by Dr. Sterling, carried.
The next meeting date
will be set for some time in July. The
Bureau secretary will contact the Board will possible dates.
Motion was made by Dr.
Sterling to adjourn at 1:55 p.m. Seconded
by Dr. Moldenhauer, carried.
