                SUBJECT:          Complaint Investigation Report 

FY2006: To date,  two (2) complaints have been received, both of which remain under investigation.

FY 2005: Seventeen (17) complaints have been received. Of those, thirteen (13) are under investigation; one (1) was referred for administrative action;  and three (3) await Board determination.

FY 2004: Twenty-two (22) complaints were received. Of those,  ten (10) have been closed;  five (5) were referred for administrative action;  six (6) remain under investigation or pro-review; and one (1)awaits Board determination.   

There is one (1) pending administrative action.

For Board Determination:

CHI-P5-2-2005-14                 C alleges that R billed for services not provided; using erroneous billing codes; excessive charges for copies of records; encouraged C to exaggerate pain; and threatened to turn C's account over to collection agency. C noted that account was later turned over to a collection agency. C also alleges that R & staff have been rude and non-cooperative. C was interviewed and records were reviewed. INV revealed that C was confused and misunderstood or misinterpreted statements made by R. INV did not reveal evidence to support the allegations or a violation of law or rule. IBOL recommends the Board authorize closure. 

CHI-P3C-1-2005-13              C alleged that R made inappropriate comments; inappropriate touching; and caused severe pain from an adjustment. C later went to ER with back pain. C continued to have therapy and requested MRI & CAT scan. C's medical history includes hypertension, hyperlipidemia, PTSD "severe", Dementia, bipolar effective disorder, & "severe' depression with supporting medications. Dr. could not confirm injury by R. INV revealed that R denied the allegations and was very cooperative. INV did not reveal evidence to support the allegations or a violation of laws or rules. IBOL recommends the Board authorize closure. 

CHI-P4A-2-2005-7                C alleges R is using a capper to solicit clients. C failed to provide information or respond to INV requests. No evidence was provided to support the allegations. IBOL recommends the Board authorize closure. 

CHI-P4B-2-2004-15               C alleges R took unnecessary x-rays and excessively billed Blue Cross. C was contacted and statements and documentation received. R was contacted and provided a written statement but refused to provide requested documents or x-rays.  INV revealed that R's billing practices appeared to be appropriate, and that the need for additional x-rays was within R's discretion. File was sent to DAG for review. Review concluded that R's billing practices were appropriate and the need for x-rays was within R's discretion.  In spite of the fact R failed to provide patient records subsequent to IBOL's request, the available evidence does not support the allegations or a violation of law or rule. IBOL recommends the Board authorize closure with an advisory letter encouraging compliance with investigative requests.
