MINUTES OF MAY 18, 2001

The meeting was called to order by Chairman Raymond Hudson at 9:00 a.m. in the Coeur d’ Alene Resort.
Chairman Hudson welcomed Mr. Reese to the board. Governor Kempthorne appointed Mr. Reese; his term commenced March 9, 2001 and will expire January 6, 2006.
Moved by Mr. Latham, seconded by Mr. Nelson, that the minutes of February 2, 2001 be approved with clerical corrections, motion carried. Mr. Reese abstained.
Mr. Limbaugh reviewed the financial report as of May 15, 2001 with the board. Mr. Limbaugh was asked to review why the current fiscal year expenses are less than the previous year and report to the board at their next meeting. Mr. Nelson moved, seconded by Mr. Giltzow, to approve the report, motion carried.
Mr. Limbaugh informed the board that he had been named by NCARB President-elect Bill Bevins to serve as a member of the CCMS Task Force for the coming fiscal year.
Mr. Limbaugh asked that he be granted permission by the board to serve on the task force. Mr. Nelson moved, seconded by Mr. Latham, to approve the request, motion carried.
Mr. Limbaugh presented the Investigative Report dated May 16, 2001, prepared by John Kersey, Chief Investigator. To date, five (5) complaints have been received. Of those, ARC-L1-02A-01-001, alleged unlawful advertisements using the term "architect", has been closed. Respondents corrected all advertising and are now under compliance. The remaining four (4) are still under investigation. Ten (10) complaints were received in the year 2000. Of those, four (4) are still under investigation. Mr. Latham moved, seconded by Mr. Giltzow, to approve the report, motion carried.
Mr. Limbaugh reviewed House Bill 32, board sponsored legislation, which was passed by the 2001 Idaho legislature and signed by the Governor to become law July 1, 2001. The legislation added the authorization for the use of an electronic seal to be used on electronically transmitted documents and to authorize the use of the term "Architectural Intern". Mr. Nelson will write a draft rule defining the term "Architectural Intern" and its use to be reviewed by legal counsel, Mr. Roger Hales.
NEW BUSINESS
Mr. Giltzow moved, seconded by Mr. Latham, to instruct Mr. Limbaugh to review the possible following Statute changes with Mr. Hales for the 2002 legislative session.
To add or change the necessary language under Violations and Penalties, Idaho Code 54-310, to grant authority to the Attorney General or a designee to enforce the provisions of Title 54, Chapter 3, or to prosecute any person violating the same.
To add or change the necessary language adding equivalency under Licensure by Endorsement, Idaho Code 54-302A.
10:00 a.m.- Mr. Paul Blanton presented questions to the board regarding the reinstatement of his Idaho license. Bureau and board records show that Mr. Blanton’s license was cancelled June 30, 1991. Mr. Blanton left the meeting.
Mr. Nelson moved to instruct Mr. Hales to review the licensure options available and respond in writing to Mr. Blanton. And that if Mr. Blanton applies for licensure reinstatement, an additional board interview would not be necessary. Seconded by Mr. Latham, motion carried.
Continuing Education was discussed. The board will review the model law and model regulations of NCARB. The board will also discuss C.E. with the A.I.A. No formal action was taken.
Mr. Nelson discussed the idea of a State Jurisprudence Exam. No formal action was taken.
OLD BUSINESS
The board reviewed the list of Idaho Interns registered in the NCARB IDP program.
CORRESPONDENCE
The board reviewed the NCARB disciplinary report, proposed NCARB resolutions to be acted upon at the 2001 Annual Meeting and Conference and the board business file.
FILE REVIEW
Applications for Examination and Endorsement without Blue Cover were reviewed.
The next regular meeting will be held on September 14, 2001.
Mr. Giltzow moved, seconded by Mr. Nelson, to adjourn, motion carried. 3:30 p.m.
