The meeting was called to
order at 9:30 a.m. by Chair, Therese Hahn.

Member, was present at 9:40 a.m.
Meeting minutes from
April 25, 2003 was discussed. The
board noted two typographical errors. Motion
was made by Ms. Hahn to approve the minutes with the two typographical errors
corrected. Seconded by Ms. Kuty,
carried.
Rayola Jacobsen presented
the legislative report. Ms.
Jacobsen explained that there was a law change stating that no pre-filed bills
could be submitted by agencies for this year.
All agencies can take RS’s to the respective house or senate.
The house or senate will then present these to committees.
The committees will make the determination of which RS’s get a number.
Ms. Jacobsen recommended only taking proposed rule changes to the
legislature.
Mr. Hetrick gave the financial report. There is a link on the Bureau’s website to the financial report. The current number of licensee’s has been added to this link. The bureau is in the process of converting the license system to a web based system. As of June 30, 2003 the board had $1,909.58 left of their budget.
Mr. Hetrick gave the investigation
report. As of July 22, 2003,
there have been no complaints for fiscal year 2004.
There are 4 investigations open from previous years.
Continuing education
implementation was discussed. Persons
licensed in both Acupuncture and Chiropractic will be required to take the extra
15 hours of continuing education prior to the renewal of an Acupuncture license.
It was suggested Mr. Hales draft a letter to take to the Chiropractic
Association regarding the continuing education requirement in Acupuncture. The board asked Mr. Hales to draft a letter to send to all
persons licensed in both Acupuncture and Chiropractic giving notice of the
Acupuncture continuing education rules. (“Chiropractors Beware.
For those of you who have a license or certificate in Acupuncture, please
read the attached rules.”) Question
was asked if 12 hours of the continuing education could be on risk taking,
documentation and management practices. The
board discussed if the NCCAOM would accept that many hours in risk taking and
management practices, though not without reviewing course documentation. The board may want to make it the licensee’s responsibility
to get written approval from the NCCAOM on seminars in question.
Mr. Downey noted that documentation is an issue for Chiropractors right
now, and risk management would go along with that.
Ms. Hahn noted that documentation and record keeping is germane to the
practice of Acupuncture, and that NCCAOM has limited the number of continuing
education credits allowed for risk management, documentation, etc..
The board felt the bulk of the continuing education should be related to
the practice of Acupuncture. Mr.
Hales noted that it would be the board’s responsibility to review the nature,
instructors and scope of the course on courses that have not been approved by
NCCAOM. Ms. Yocum noted that there
is a pre-approval process for NCCAOM online.
If there is a course someone is wanting approved for continuing education
credits, they could go to this website and submit the course for approval from
NCCAOM. The board asked about
drafting a form that persons wanting course approval could complete and submit
to the board. Mr. Hetrick noted
that the Bureau does have an application for continuing education requests that
could be made available to Acupuncturists.
Mr. Hetrick stated that he would have that form available on the website
by the end of the day. Ms.
Kuty asked Ms. Hitesman to be sure to point out the continuing education rule
305-1 to persons calling regarding continuing education approval.
Question was asked if a preceptor course would be something the board would be willing to approve. The board decided if the NCCAOM has approved the preceptor course, then the board would also approve it. Question was asked as to what date the board would start the continuing education audit process. The board determined that audits would start on the person’s next renewal after July 1, 2004. Mr. Hales noted that the rule went into effect May of 2003, so licensees would have to have completed their 15 hours of continuing education by their next renewal. The board noted that most licensees are just becoming aware of the continuing education rule. Mr. Hales stated that if the board wants to wait to audit continuing education until after July 1, 2004, they would need to make a rule change. The bureau informed the board that, when the renewal forms are sent out to licensees, an affidavit of CE compliance will be included. The licensee is required to sign stating they have met this requirement. The board asked legal council if they could amend the rule to change the starting date of completing continuing education to July 1, 2004. Ms. Yocum noted that this rule had become a permanent rule during the last legislative session. Mr. Hales concurred with this.
Motion was made by Mr.
Peebles to amend the continuing education rule to reflect that persons renewing
for Acupuncture license after July 1, 2004 will be required to complete 15 hours
of continuing education. Seconded
by Ms. Kuty, carried.
Motion was made by Mr.
Peebles to amend his motion to amend rule 302-01-B to make it a temporary rule
and add to the beginning of the sentence, “Beginning July 1, 2004.”
Seconded by Ms. Kuty, carried.
The board noted that
anybody who renews their license after July 1, 2004 would need to have 15 credit
hours of continuing education. The
board asked if a memo drafted by Mr. Hales would go out to all licensees.
Mr. Hales noted that a newsletter could go out from the Acupuncture
Association. Mr. Downey will have
the Chiropractic Association draft a memo and have them refer all questions to
the website. The Bureau noted that
continuing education audits would be done randomly to check compliance.
The board can decide what percentage of licensee’s are audited each
year. Mr. Hetrick explained that
each licensee that is audited is flagged in our database.
Those licensee’s audited will receive a renewal notice that states they
have been audited and need to send in verification of compliance of continuing
education. These verifications are screened and held for the boards
review. The license will be printed
for the licensee if they submit the required information. Mr. Hales noted that if a licensee signs the affidavit
stating they have met the required continuing education hours, and it is later
discovered they did not meet the required continuing education hours, the Board
could take disciplinary action. The
board discussed sending a form along with all renewal forms asking the licensee
to list the name and date of continuing education courses that licensee attended
in the previous 12 months. The
Bureau noted that the board would than have to review every renewal form that
came in. This would be an expense
for the board, and documentation would have to be maintained. The Bureau explained that most boards use only the affidavit
on the renewal form, and then the board audits a percentage of licensees to
ensure that compliance is being maintained.
The Bureau does have two boards that require a 100% audit, and one board
that asks for a list of the courses attended, but does not ask for proof of
attendance unless audited. The
board would like to have something more than just the affidavit that the
licensee signs, to monitor the courses taken do pertain to Acupuncture.
Mr. Hetrick noted that the bureau has a renewal form for those who are
being audited for continuing education and a separate form for the licensee to
list all continuing education courses taken for the previous 12 months.
Mr. Hetrick noted he would put the different renewal forms that the
Bureau uses on the website for the board to look at, and e-mail the website
address to each board member. The
board decided to look over these different renewal forms and discuss this topic
further at the next board meeting. Mr.
Hetrick noted that there are currently 125 active licensees.
If the board were to audit 100%, the board would have to review
approximately 10-15 continuing education verifications each month.
The Board discussed the open book Jurisprudence Exam. It was discussed adding a continuing education question to the exam. The board noted that most applicants seem to miss question #8.
Motion was made by Ms.
Yocum to delete question #8 on the jurisprudence exam and replace with a
continuing education question. Seconded
by Mr. Downey, carried. Mr. Hetrick
will prepare this question for the jurisprudence exam.
Motion was made by Ms.
Kuty to go into executive session to discuss documents exempt from public
disclosure. Seconded by Ms. Yocum, carried.
Discussion was made
regarding the FAOMRA membership. Ms.
Kuty will attend the November FAOMRA meeting.
Motion was made by Mr. Downey to send two members of the board to the
November FAOMRA meeting and authorize the payment of expenses and dues for
FAOMRA. Seconded by Ms. Yocum,
carried.
Next board meeting was
set for October 24, 2003 at 9:30 a.m.

Yocum to adjourn. Seconded by Ms.
Kuty, carried.
