The meeting was called to order at 9:40 a.m. by Chair,
Therese Hahn.
The Board discussed case #s ACU-B2A-2-2002-2 and ACU-P3C-2-2002-3.
Mr. Hales reported that the allegations against the
respondent included continued practice with an expired license, practice beyond
the scope of licensure, and inappropriate client contact.
A complaint was issued to the respondent and no response has been
received. The Attorney General’s Office is recommending that the Board enter a
notice of proposed default against respondent.
Respondent would then have 7 days to petition the Board.
If a petition is not filed, a judgment could be entered against the
respondent.
Mr. Peebles stated that the respondent had been served
adequate notice, and the Board should go ahead with the process.
Ms. Yocum moved that the Board entering a notice of proposed default
against the respondent. Motion was seconded by Mr. Peebles, and carried.
The Board reviewed
correspondence regarding Judy Kay Carter and her request for reconsideration of
her practice restrictions. Ms. Carter currently holds an Acupuncture Technician
Certificate. According to the
letter submitted by her attorney, Ms. Carter has completed one course of
training that the Board feels would relate to Acupuncture.
Ms. Hahn moved that a letter be sent to Ms. Carter requesting
documentation of each of the course studies referenced in her attorney’s
letter, be sent to the Board for further review of Ms. Carter’s
qualifications, and that Ms. Carter clarify for the Board which restrictions she
would like lifted. Motion was
seconded by Ms. Yocum, and carried.
Moved by Ms. Hahn at 10:15 a.m. to adjourn.
Seconded by Ms. Kuty, and carried.
