IBOL COMPLAINT MEMORANDUM

            TO:                  Idaho State Board of Acupuncture

            SUBJECT:       Investigative Report

FY2008: To date, no complaints have been received.

FY2007:  Three (3) complaints were received. Of those, one (1) has been referred for legal review;  and two (2) are under investigation.

FY2006:  One (1) complaint was received.  That matter was closed subsequent to Board determination.

FY2005:  Four (4) complaints were received.  Of those: one (1) awaits Board determination; and three (3) remain under investigation.

For Board determination:

ACU-P1-1-2005-2:            C alleged that R is practicing Acupuncture W/O a license as supported by billing and client notes.  IBOL review concludes that this matter could not be investigated as an ACU complaint, as it involves a licensed CHI and falls under the scope of practice issue.  IBOL recommends the Board authorize closure due to lack of jurisdiction.
